Terms of Service
Last updated: 24 August 2026
1. Agreement
These Terms of Service ("Terms") govern your use of IndieWall (the "Service"), operated by Francesco Cogliandro ("we", "us"). By browsing the board, publishing an ad, or paying for a slot, you agree to these Terms and our Privacy Policy.
Questions: francescocogliandro.com.
2. The Service
IndieWall lets you select cells on a public grid and display an indie app or game listing for a chosen duration. Listings may appear in the board and in the public app list. We may change grid size, pricing, durations, or features at any time.
No traffic guarantee. Buying a slot does not promise clicks, downloads, rankings, or any particular result. The board is a discovery surface, not a performance marketing network.
3. Eligibility
You must be able to form a binding contract and must only publish apps/games you are authorized to promote. If you act for a company, you confirm you have authority to bind that company.
4. Ads and content rules
You are solely responsible for your listing content. You agree not to publish:
- Illegal, fraudulent, or misleading content
- Malware, phishing, or links that harm users or devices
- Hate, harassment, sexual content involving minors, or other prohibited material
- Content that infringes IP, privacy, or other rights of third parties
- Ads for products unrelated to legitimate indie apps/games when we reasonably consider them off-scope or abusive
Icon and store URLs must point to real, accessible assets and store pages. We may refuse, hide, expire early, or remove any listing that violates these Terms or harms the Service, without refund except where required by law.
5. Purchases and refunds
Prices are shown before checkout (per cell and duration). Payments are processed by Stripe when configured. Until payment succeeds (or a free publish mode is explicitly enabled), the slot is not confirmed as an active paid placement.
Fees are generally non-refundable once the listing is activated, including if you remove the ad early, if traffic is low, or if your store listing is rejected by Apple/Google. If a technical fault on our side prevents activation after a successful payment, contact us and we will fix activation or refund at our discretion.
You can extend or delete ads using the email you provided at purchase via the manage page.
6. Your license to us
You grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your listing content on IndieWall for the purpose of operating the Service for the duration of your placement and any reasonable archival/technical copies.
7. Intellectual property
IndieWall branding, layout, and software are ours or our licensors. You keep ownership of your app name, icons, and creative. Do not copy the Service or scrape the board in a way that overloads or harms it.
8. Availability
We aim for reliable uptime but do not warrant uninterrupted or error-free service. Maintenance, outages, or third-party failures (hosting, Stripe, Firebase, stores) may occur.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of data, goodwill, or business opportunity arising from the Service or any ad.
Our total liability for any claim relating to a paid placement is limited to the amount you paid us for that placement in the 3 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law (e.g. death/personal injury caused by negligence, or fraud).
11. Indemnity
You agree to indemnify and hold us harmless from claims, damages, and costs (including reasonable legal fees) arising from your listings, your breach of these Terms, or your violation of others' rights.
12. Termination
We may suspend or terminate access to the Service or remove listings for breach, abuse, legal risk, or operational reasons. You may stop using the Service and delete your ads via manage (or by contacting us). Sections that by nature should survive (including IP, disclaimers, liability limits, indemnity) survive termination.
13. Governing law
These Terms are governed by the laws of Italy, without regard to conflict-of-law rules. Courts of competent jurisdiction in Italy shall have exclusive jurisdiction, except where mandatory consumer protections in your country of residence require otherwise.
14. Changes
We may update these Terms. The "Last updated" date will change. Continued use after an update constitutes acceptance. If you disagree, stop using the Service and remove your ads.
